01-15-2020 Planning Board Meeting Minutes




Call to Order: Linda Bond-Clark called the January 15th meeting to order at 6:00 p.m. at the New Haven Town Hall. Roll call: Linda Bond-Clark, William Calderone, Josh Downing, Cindy Giovo, Patricia Parkhurst, Kathy Phelps, James Searles and Karen Valentino present. absent.

Annual Organizational Meeting: Tabled

Dollar General: Daniel Griffiths from Griffiths Engineering LLC attended the meeting representing Dollar General. Dollar General is proposing to build a 9,100 square foot store on a 2.52-acre lot located at 4290 St Rt 104. The property is part of a parcel tax map # 114.00-02-10.1 which is currently 52.48 acres.

Mr. Griffiths reviewed the project.

The maximum height of the building will be 18 feet.

Dollar General had been talking to the owner of Hazzy’s as an alternate site. They are moving forward with the current location.

A 6-foot fence or other visual barrier is required between a commercial site and a residential site. A plan for this is needed. If the owner of the residential property to the east of the site does not want a fence or visual barrier, the applicant can apply for a variance.

The items needed for the next meeting are:

  • Variance application for:

    • Number of parking spaces

    • Size of each of the 2 signs

  • Photometric C6 report

  • Elevation drawings for each side of the proposed building to include height and width dimensions for the building, signs, windows and doors.

  • Sustainability Report

  • A plan for a fence or visual barrier between the site and the residence to the east or a variance application

The applicant will also need to submit the following as they become available:

  • Army Corp 45-day report

  • DOT Trip Generation Report

  • County Septic Report

Raymond Abbott Manufactured Home Park: Raymond Abbott has resubmitted his application for a manufactured home park license for 5 mobile homes at 319 – 323 Co Rt 43. Tax map #s 098.00-01-44.2 & 098.00-01-44.1.

His site plan was drawn to scale with each square equal to two feet.

Variances will be needed for setbacks on both the north and south sides. A variance will also be needed for the sizes of each individual site within the park.

Possible alterations were discussed to help make the individual sites within the park large enough that a variance is more likely to be granted.

Mr. Abbott will bring a copy of the lease he uses as the required park rules.

Dan Barney, who owns property on three sides of the proposed site, stated that he was very much in favor of the project.

At the request of the applicant, the application will next be on the agenda for the March meeting.

Mr. Abbott will bring the following to the March meeting:

  • Survey

  • Site plan with any revisions and measurements shown

  • Variance application for:

    • Setback from north and south property lines

    • Area variance for each individual site with in the park

    • Possibly the width of the park road

Plans for sewer lines and power lines will be submitted as they become available.

Fred Wilbur Resignation: Fred Wilbur has resigned from the planning board as he has been elected to the Town Board and NYS Town Law says serving on both boards is a conflict of interest.

Local Law #2 of 1994: Tabled. Review will continue at the next meeting with Article 9C.
