 NEW HAVEN PLANNING BOARD MEETING HELD JUNE 15, 2016

Call to Order: Linda Bond-Clark called the June 15th meeting to order at 7:00 p.m. at the New Haven Town Hall. Roll call: Linda Bond-Clark, Robert Parkhurst, Kathy Phelps Frederick Wilbur and Patricia Parkhurst present. William Calderone and James Searles absent.

Public Hearing on Paul & Shelly Scott Variance: Linda Bond-Clark opened the public hearing on the variance application of Paul & Shelly Scott to put a manufactured home on their property, at 506 Co. Rt. 1, tax map #097.00-01-42, in addition to the existing residence on the property at 7:00. The manufactured home will be occupied by a family member. There were no members of the public present. The board members briefly discussed the application. Having no public comments the public hearing was closed at 7:05 by motion of Frederick Wilber, second by Kathy Phelps. Paul & Shelly Scott Variance: Motion by Frederick Wilbur, second by Robert Parkhurst, to accept the variance application of Paul & Shelly Scott to put a manufactured home on their property, at 506 Co. Rt. 1, tax map #097.00-01-42, in addition to the existing residence on the property based on the following considerations:

  • Letters of approval have been submitted from 3 neighbors.

  • The manufactured home will be occupied by a family member of the owner of record.

  • The project meets all setback requirements.

  • Less than a 50% variance from minimum lot size is required.

  • The new manufactured home will be setback beyond the existing residence.

  • There is sufficient space between the 2 residences.

  • Both residences will use municipal water.

  • The project will comply with all applicable state & local laws, rules & regulations.

  • The size of the manufactured home is as represented in the diagram submitted.

  • There were no objections voiced at the public hearing held at 7:00 on June 15, 2016.

Kristopher and Christen Anderson Variance: Kristopher and Christen Anderson have submitted a variance application divide the property, at 12 Wintergreen Pt Dr, tax map #081.19-01-10 into two equal parcels, each 50 feet wide.

Basis For Consideration:

  • A variance of 35% of the required frontage of 80 feet is requested.

  • The new lot sizes are in keeping with the character of the neighboring lots with single family structures.

  • Municipal water is available.

  • The project will comply with all applicable state & local laws, rules & regulations.

  • A setback variance will be applied for before building on the new parcel.

  • All future construction will be 2 stories or lower.

  • Public utilities are available.

  • Both properties meet the depth requirement.

  • Letters of approval have been submitted from the 2 neighbors to the west of the property.

  • Total lot size of each of the parcels exceeds the minimum required for a lake front lot.

  • The surrounding lots are approximately the same size as the two lots which are the subject of the application will be if the variance is granted.

SEQR Lead Agency: Motion by Robert Parkhurst, second by Frederick Wilbur, to take lead agency for the SEQR on the project. Linda Bond-Clark, Aye; Patricia Parkhurst, Aye; Robert Parkhurst, Aye; Kathy Phelps, Aye; Frederick Wilbur, Aye Carried.

SEQR Negative Declaration: Motion by Frederick Wilbur, second by Kathy Phelps, to declare a negative declaration for the SEQR on the project. Linda Bond-Clark, Aye; Patricia Parkhurst, Aye; Robert Parkhurst, Aye; Kathy Phelps, Aye; Frederick Wilbur, Aye Carried.

Complete Application: Motion by Frederick Wilbur, second by Kathy Phelps, to accept the application as complete. Linda Bond-Clark, Aye; Patricia Parkhurst, Aye; Robert Parkhurst, Aye; Kathy Phelps, Aye; Frederick Wilbur, Aye Carried.

Public Hearing: Motion by Kathy Phelps, second by Frederick Wilbur, to hold a public hearing on the variance application of Kristopher & Christen Anderson at 7:00PM on July 20, 2016. Linda Bond-Clark, Aye; Patricia Parkhurst, Aye; Robert Parkhurst, Aye; Kathy Phelps, Aye; Frederick Wilbur, Aye Carried.

Site Plan Review Ordnance: a portion of the Preliminary Site Plan Review Ordnance was reviewed and suggested changes were made.

Adjournment: Meeting adjourned at 8:10 by motion of Frederick Wilbur second by Robert Parkhurst. Unanimously carried.
